Terms & Conditions: ExpertWeb Websites Monthly Subscription Payment Plans

All websites are subject to a minimum term of either 12 or 24 months (fee varies by subscription package). Payment is collected monthly by direct debit or credit card.

Terms & Conditions

By entering in to a contract agreement with LoyaltyMATTERS Ltd (trading as ExpertWeb from the website https://estateagents-websites.com), you (“the client”) are accepting the following terms and conditions (“the terms”). If you do not agree to the terms, you must not enter a contract with LoyaltyMATTERS Ltd. Upon entering into a contract with LoyaltyMATTERS Ltd, you are committing to a monthly payment plan (“your fee”) for a minimum period of 12 or 24 monthly payments dependent upon the subscription package you select (our template based websites have a minimum term of 12 monthly payments whilst our designer and marketer based websites have a minimum term of 24 monthly payments). The contract will commence on the date on which you place your order with us and pay your first months fee. The second and subsequent monthly fees within your payment plan (“your fee”) will be due monthly from the date your website build is complete (“payment date”).

Your fee will be determined by the subscription you have agreed with LoyaltyMATTERS Ltd. A deposit fee of one month’s subscription is payable at the time of order. Your fee will have been detailed on our order form which will have been completed online, emailed, posted or given to you during a face to face meeting. You will have deemed to have entered into an agreement with us by submitting your order form online, by signing our order form or by replying to our email with an instruction to proceed.  Your initial deposit / first month’s payment fee can be made by direct debit, credit card, cheque or direct bank transfer. Payment for monthly fees beyond this will usually be collected by direct debit (in the name of Go Cardless) or by credit card (in the name of Stripe). By agreeing to this contract, you are accepting the fee stated, and are then bound to pay that fee monthly on your payment date for a minimum period of 12 or 24 monthly payments, dependent upon the subscription package you have selected.  If for whatever reason you are unable to make payment by direct debit or credit card, you must still pay your fee on your payment date either via BACS or another method as agreed with a LoyaltyMATTERS Ltd. You will receive an invoice via email for each payment of your fee made.

Your fee covers the services as stated under the specific subscription plan of choice only. Once you have entered into a contract with LoyaltyMATTERS Ltd, your fee will not change until at least the minimum 12 or 24 month contract has expired, unless a negotiated upgrade or downgrade of service is agreed with you. If we agree to a change in your fees, then it will come in to force on your next payment date, unless otherwise agreed. Changes to your fee may also increase the remaining minimum term which will be agreed with you as part of the variation to your contract.

Your monthly payment is for the initial website design and development, the provision of a sophisticated content management system (CMS), hosting fees and the ongoing help and support of our technical team. Fees also include the setting up and integration of a database feed from your chosen CRM software provider (provided we are able to accept a feed from them) or the inclusion, within your CMS, of our highly sophisticated property management section, from where you can add new / edit existing properties for sale and / or to let and automatically post these properties to the various portals that you choose to advertise with (eg Rightmove, Primelocation, Zoopla etc).

All websites with us include the option to have a free re-design of the site after 24 months or, if applicable, after any negotiated extended term. If you require a complete re-design before the 24 months have elapsed a fee will be applicable which will be discussed and agreed with you in advance of the work being undertaken. LoyaltyMATTERS Ltd reserves the right to request additional payment to cover any work that exceeds fair use of the services included within the client’s subscription package.

LoyaltyMATTERS Ltd is not responsible for the accuracy or veracity of materials on a client’s website and the use of these websites is at the visitors’ or clients’ own personal risk. LoyaltyMATTERS Ltd or any of its officials shall not be liable for any loss, claims, damages or any special, consequential, exemplary or punitive damages of any kind arising from the access and/or use of a client’s website.

You (the client) acknowledges that any material uploaded using the Websites paid monthly content management system or sent to LoyaltyMATTERS Ltd for build or maintenance purposes is free of any copyright restrictions and belongs to the client for distribution and use.

LoyaltyMATTERS Ltd reserves the right, at its discretion, to add, edit or remove content from this website (“the website”) or to adjust or revamp the design of the content management system at any time. It also reserves the right to monitor, suspend, revoke or otherwise limit access to the website at any time. The website is wholly protected by copyright law and the contents of the website are available to any user for personal reference only and may not be reproduced in any form whatsoever either in whole or part without the prior written permission of LoyaltyMATTERS Ltd and its officials.

You (the client) acknowledges that if you fail to complete our design approval form, preventing us from progressing to the build of your website, all design work carried out, whether experimentally or otherwise, at your request shall be chargeable in full based upon our prevailing hourly rate at that time.

You (the client) acknowledges that the “payment date” is determined by us as being the date at which we have completed the build of your website to the agreed design and have supplied you with a development URL. If you have supplied any text and / or images during the design and build process, we will include these at this stage. Otherwise we will complete the build with placeholder text and images. If the website cannot go live (ie move from a development URL to the final URL) because we are awaiting copy (text), images and / or any other content from you, or we are awaiting you to complete our online ‘website go live’ form, subsequent monthly payments (“your fee”) will still fall due from the date (payment date) the build is complete. At our absolute discretion and subject to there being no delays with you supplying content to us, we may agree to the “payment date” being the date we move the website to its final URL.

If you fail to pay the fees due (“your fee”) within the agreed terms, loyaltyMATTERS Ltd reserves the right to raise an invoice for the unexpired term of the contract (“your fee”), to charge an administration fee to cover its debt recovery costs and to charge interest on the overdue debt at 2% above the HSBC base rate at the time.
